NRI Guide to Buying Property in Noida and Gurugram (2026)

NRI Guide to Buying Property in Noida and Gurugram (2026)
Contents

If you live abroad and want a home in Delhi NCR, Noida and Gurugram are the two names that come up first. The process is open to NRIs, but the paperwork is stricter than for a resident buyer. This guide covers the rules that matter for NRI buying property Noida Gurgaon: what FEMA allows, how to pay, power of attorney, home loans, registry costs in Uttar Pradesh and Haryana, getting money back out, and tax on rent.

Rules and rates change. Everything below was checked in October 2026. Confirm the current position with your bank, a chartered accountant and a local property lawyer before you pay anything.

What FEMA allows NRIs to buy

Under FEMA, NRIs and OCIs can freely buy residential and commercial property in India without RBI permission. There is no cap on the number of properties or their combined value.

There is one major exclusion. NRIs and OCIs cannot buy agricultural land, plantation property or farmhouses. They can only get these by inheritance or as a gift from a resident Indian, under FEMA conditions. This matters in NCR, where some farmhouse-style plots are sold near the city edges. Check the land-use classification before you pay a booking amount.

For under-construction flats, verify the project’s RERA registration, run title checks and get a PAN card. Those steps are the same as for any buyer, but they are harder to do from another country, so allow time.

How to pay: NRE, NRO, FCNR or direct remittance

All payments must go through banking channels. Acceptable sources are inward remittances by SWIFT, funds in NRE or NRO accounts, and rupee home loans from Indian banks. Cash and traveller’s cheques are not allowed.

Your choice of account affects what you can send back later.

Account What it holds Repatriation
NRE Foreign earnings converted to rupees Fully repatriable
NRO Indian-sourced income such as rent and dividends Subject to the USD 1 million annual cap
FCNR Deposits held in foreign currency Fully repatriable at maturity

If you may want to move the money abroad someday, buying with NRE or FCNR(B) funds is the simpler route. If you buy jointly with a resident relative, the NRI’s share must still come through NRE, NRO or FCNR channels, while the resident co-owner can pay from a regular account.

Home loans for NRIs

Most large banks and housing finance companies lend to NRIs. Eligibility differs by lender. Common requirements are a valid Indian passport (or OCI/PIO status), one to three years of employment abroad, and an active NRE/NRO account. SBI, for example, asks for at least two years abroad. EMIs are paid from NRE/NRO accounts.

How much will the bank fund? Loan-to-value limits fall as the price rises. One published SBI schedule gives up to 90% for properties up to ₹30 lakh, up to 80% for ₹30–75 lakh, and up to 75% above ₹75 lakh. Other aggregator pages quote slightly different splits, so ask each lender for its own schedule.

Interest rates: We could not find one reliable current figure. Comparison sites quote ranges from roughly 7.15% to 8.75% up to 13.20% at the top end for HDFC Bank. These are floating rates, so they move when the RBI changes the repo rate. Get a written quote before you rely on any number.

Worked example (illustrative). Take a ₹1.2 crore flat in Noida, bought by a man:

  • Loan at a 75% limit: ₹90 lakh. Your own contribution: ₹30 lakh.
  • Government charges at Noida rates (7% stamp duty plus 1% registration): ₹8.4 lakh plus ₹1.2 lakh, so ₹9.6 lakh.
  • Cash needed upfront, before legal fees, GST on an under-construction flat and parking: about ₹39.6 lakh.
  • EMI on ₹90 lakh over 20 years at an assumed 8.5%: about ₹78,000 a month. The 8.5% is our assumption for the example, not a lender quote.

Power of attorney (POA): buying without flying in

Many NRIs sign through a trusted person in India. A POA lets that person act for you. It authorises the act of registration but does not transfer ownership by itself.

The usual steps:

  1. Draft it narrowly. A Special POA is preferred over a General POA, with powers defined as tightly as the transaction allows. Name the property and list the exact acts allowed.
  2. Sign abroad. You sign before a notary or before the Indian Embassy or Consulate in your country.
  3. Authenticate it. If your country is in the Hague Apostille Convention, one apostille is generally enough. Otherwise the Indian embassy or consulate attests it. There is a catch. Sub-registrars often still ask for Indian consular attestation even where an apostille exists, so getting both is the safe route. Ask the sub-registrar’s office what it will accept before you sign.
  4. Courier the original. Send the original, not a scan, because that is what gets stamped and registered.
  5. Stamp and register in India. A POA covering the sale or transfer of immovable property must be stamped and, in most states, registered with the sub-registrar. Some providers say stamping must happen within three months of execution abroad. Treat that as a deadline to confirm locally.

In Haryana, stamp duty on a Special POA is ₹100 and on a General POA ₹300. We could not confirm the equivalent Uttar Pradesh charges, so ask the Noida sub-registrar. Haryana’s registration process also reportedly involves biometric verification of buyer, seller and witnesses, so plan around your attorney’s availability.

UP vs Haryana registry: what you pay

Noida falls under Uttar Pradesh. Gurugram falls under Haryana. Stamp duty and registration are the main government costs, and the two states work differently. We found no separate rate for NRIs in the rate cards we reviewed, so the buyer’s gender and ownership type decide the rate.

Item Noida (Uttar Pradesh) Gurugram (Haryana)
Stamp duty, man 7% 7% within municipal limits
Stamp duty, woman 6%, with a ₹1 crore condition (see below) 5% within municipal limits
Stamp duty, joint (man and woman) 6.5% 6% within municipal limits
Registration fee 1%, uncapped Slab-based, capped at ₹50,000 (the top slab applies above ₹90 lakh)
Valuation basis Higher of sector circle rate or sale value Higher of circle rate or transaction value

Outside Gurugram’s municipal limits, Haryana charges 5% for men and 3% for women.

Two details to check. First, the UP women’s concession is reported inconsistently. Some sources describe a 1% rebate on homes up to ₹1 crore, while others still describe a flat ₹10,000 rebate. Above ₹1 crore the treatment depends on the current notification, so confirm on the IGRS UP calculator. Second, one 2026 guide says Haryana has run on a paperless e-registration portal since 1 November 2025. We found only that one source, so check with the sub-registrar’s office how your slot is booked.

Worked example: a ₹1 crore flat (the value is above the circle rate):

Buyer Noida Gurugram (urban)
Man ₹7,00,000 + ₹1,00,000 = ₹8,00,000 ₹7,00,000 + ₹50,000 = ₹7,50,000
Woman ₹6,00,000 + ₹1,00,000 = ₹7,00,000 ₹5,00,000 + ₹50,000 = ₹5,50,000
Joint (man and woman) ₹6,50,000 + ₹1,00,000 = ₹7,50,000 ₹6,00,000 + ₹50,000 = ₹6,50,000

These figures exclude small document fees and legal costs. The gap comes mostly from the registration fee. In Noida it grows with the price. In Gurugram it stops at ₹50,000. If you plan to put a woman family member on the title, ask your lawyer how that affects ownership, loan eligibility and tax before you decide on rate savings alone.

Repatriation: getting your money back out

Plan this before you buy. The rules depend on how you paid.

  • Bought with NRE/FCNR funds or foreign remittance: Sale proceeds can be repatriated for a maximum of two residential properties in a lifetime. The amount cannot exceed the foreign exchange originally paid. Any gain above that can go out from the NRO account under the USD 1 million annual limit.
  • Bought with NRO or rupee funds: The cap is USD 1 million per financial year from the NRO account, across all NRO remittances. You need a CA certificate that taxes have been paid, plus an undertaking.
  • Inherited property: Proceeds go through the NRO route and the USD 1 million annual limit applies.

Worked example. You buy a flat for ₹1 crore using NRE funds and later sell for ₹1.5 crore. The ₹1 crore of original foreign-exchange investment is covered by the two-property facility. The ₹50 lakh gain, after tax, goes out through your NRO account within the USD 1 million annual cap.

The bank will ask for paperwork. A CA certificate in Form 15CB is needed, and Form 15CA is filed online before the remittance. TDS on a sale by an NRI is computed on the full sale price, not just the profit, so cash is often held back until you recover the excess. One source says a lower deduction certificate helps reduce this.

A note of caution: one site claims the 2026 Budget changed these limits. We could not corroborate that elsewhere, and most 2026 guides still describe the USD 1 million annual cap. Confirm the current position with your bank before relying on any change.

Tax on rent from your Noida or Gurugram flat

If you rent the property out, the rent counts as Indian income. It should land in your NRO account.

The tenant has a duty here. Tax must be deducted on rent paid to an NRI from the very first rupee, with no minimum limit. The rate is generally 31.2%, which is 30% plus cess. Surcharge can push the effective rate higher, up to about 42.74% in one source’s table. The tenant also needs a TAN, and one 2026-27 guide says quarterly returns are now filed in Form 144 under the Income-tax Act, 2025. The Act is new, so confirm form and section numbers with a tax professional.

Worked example. Rent is ₹50,000 a month, or ₹6,00,000 a year.

  • TDS at 31.2%: ₹1,87,200 a year, or ₹15,600 a month. The tenant pays you ₹34,400 each month.
  • This is deducted on gross rent. Your actual tax is worked out on a net figure. An ICICI Bank illustration deducts property tax paid and a 30% standard deduction from rent. Home loan interest may also reduce income.
  • If TDS is higher than your final tax, you can claim the difference as a refund when you file your Indian return. NRIs can also apply for a lower deduction certificate before the year starts.

Money you want to move abroad is still subject to the NRO route. The USD 1 million limit covers sale proceeds, rent and other Indian income combined.

A short checklist before you pay

  1. Confirm your NRI or OCI status and keep your PAN, passport, visa/OCI and overseas address proof ready.
  2. Verify RERA registration, title chain and land-use classification. Avoid anything agricultural or farmhouse-classified.
  3. Pay only from NRE, NRO, FCNR or inward remittance, and keep the bank trail.
  4. Decide your funding source with future repatriation in mind.
  5. If using a POA, check attestation and registration requirements with the sub-registrar first.
  6. Budget for stamp duty and registration using the right state rates, plus legal fees and GST where applicable.
  7. Appoint a tax professional for TDS, Forms 15CA/15CB and your Indian return.

Frequently asked questions

Can an NRI buy a flat in Noida or Gurugram without RBI approval?

Yes. NRIs and OCIs can freely buy residential and commercial property in India under FEMA without RBI permission. Agricultural land, plantation property and farmhouses are excluded.

Which bank account should an NRI use to pay for property?

NRO, NRE and FCNR(B) accounts are all accepted, as is a direct remittance from abroad. NRE or FCNR(B) funds make repatriation simpler later.

Can an NRI buy property in India through a power of attorney?

Yes, but the POA must be signed and authenticated abroad (apostille in Hague countries, or Indian embassy/consulate attestation elsewhere). It must then be stamped and, in most states, registered in India. Check the local sub-registrar's requirements first.

Is stamp duty lower in Noida or Gurugram?

Noida charges 7% for men and 6% for women, plus 1% registration. Gurugram's municipal-area rates are 7% for men and 5% for women, and its registration fee is capped at ₹50,000. On a ₹1 crore flat, a male buyer pays about ₹8 lakh in Noida and ₹7.5 lakh in Gurugram.

How much can an NRI send abroad from a property sale?

For NRE/FCNR-funded purchases, repatriation covers up to two residential properties and cannot exceed the foreign exchange originally paid. Otherwise the limit is USD 1 million per financial year from the NRO account, after tax.

How much TDS is cut on rent paid to an NRI?

TDS applies from the first rupee of rent, generally at 31.2% (30% plus cess). A lower deduction certificate or a refund claimed in your Indian return can reduce the actual tax.

Can NRIs get a home loan for a Noida or Gurugram property?

Most major banks and housing finance companies lend to NRIs, PIOs and OCI cardholders. Eligibility, loan-to-value limits and rates vary by lender, so compare written quotes.
