A resale flat in Gurugram can be the safest purchase in NCR or the most troublesome, and the difference is almost entirely paperwork. A flat in a society with an , a registered and clear municipal dues can be bought and registered in days on Haryana’s paperless system. A flat where the seller holds only an , or where the builder never obtained the OC, can leave you with a home you cannot register, mortgage or sell cleanly. This guide lists the documents to ask for, explains the two very different resale situations in Gurugram, and gives a checklist to run before you pay a token.
Two kinds of “resale” in Gurugram
| Situation | What the seller owns | How it transfers to you | Key risk |
|---|---|---|---|
| Registered resale | A flat conveyed to the seller by a registered conveyance deed after OC | A fresh sale deed registered before the sub-registrar, followed by | Old dues, loans or defects in the title chain |
| Allotment transfer (pre-conveyance) | Only contractual rights under an allotment letter and | The builder endorses or transfers the allotment to you; the conveyance deed is later executed in your name | Builder transfer charges, outstanding demands, project delay, no title until conveyance |
The Supreme Court made clear in Suraj Lamp and Industries v. State of Haryana (2011) that immovable property passes only by a registered deed, and that sales through an agreement to sell, and will do not transfer title. A seller who offers a GPA instead of a registered deed or a builder endorsement is offering you a risk, not a flat.
Documents to collect for a registered resale
- Chain of title. The builder’s conveyance deed in the seller’s favour, and every earlier sale deed if the flat has changed hands before. Each should be registered, stamped at the correct value and in the same unit number and area.
- Builder documents. Allotment letter, builder-buyer agreement and final statement of account showing nothing is due to the developer.
- Occupation certificate. A copy of the OC covering the seller’s tower. The Haryana Building Code bars occupation of any new building or part of one until the occupation certificate is issued. An OC for “Phase 1” does not cover a tower built later.
- Licence and details. The licence number for the colony and, for newer projects, the RERA registration. These show the land use is legal and help you check for pending disputes.
- Municipal No Dues Certificate. An NDC from the urban local body portal (property.ulbharyana.gov.in) for the flat’s Property ID, showing no property tax or municipal dues outstanding. It certifies dues only; it says nothing about ownership.
- Society or RWA NOC and maintenance statement. Proof that maintenance, sinking fund, electricity backup and water charges are paid up to date, and the maintenance agency’s no-dues letter.
- Utility bills. Recent electricity and water bills in the seller’s name, and the meter numbers.
- Loan closure. If the seller has a home loan, the lender’s statement of outstanding amount, and after payoff the loan closure letter, the original title documents returned by the bank, and release of the charge.
- Identity and tax. PAN and Aadhaar of all sellers; for a joint owner who is absent, a registered power of attorney limited to this sale.
- Possession and parking. The , parking allotment and any car-parking or storage rights mentioned in the conveyance deed.
Extra documents for an allotment transfer
- The original allotment letter and agreement, plus all payment receipts issued by the builder.
- A builder-issued statement showing amounts paid, amounts due and any delay interest the seller has claimed or been paid.
- The builder’s written transfer procedure and charges. Transfer or administrative fees vary between developers; get the exact amount in writing.
- For a flat with a home loan, the lender’s NOC for transfer and the , which will need to be closed or replaced by your lender’s.
- If a RERA complaint is pending, the order or case status. Under the RERA Act an allottee includes a person who later acquires the allotment through sale or transfer, so you may inherit both rights and pending claims; agree in writing who keeps any interest awarded.
Step-by-step process
- Step 1: Verify before token money. Ask for copies of the title chain, OC, NDC and maintenance statement. Do not pay a large token before your lawyer has seen them.
- Step 2: Check records. Match the seller’s name and unit details across the deed, the municipal property record and the builder’s records. Haryana’s revenue land records and the portal are useful for plots and independent houses; for flats, focus on the registered deeds and the municipal Property ID.
- Step 3: Agreement to sell. Sign an agreement to sell recording price, payment schedule, the date for the sale deed, who pays which charges, and a refund clause if documents fail. The agreement itself does not transfer title.
- Step 4: Clear the seller’s loan. Pay the seller’s lender directly from your funds or your loan, collect the original documents and closure letter.
- Step 5: Calculate . Stamp duty is charged on the higher of the deed value and the collector rate. Haryana’s collector rates for 2026-27 took effect on 1 April 2026; the final list for Tehsil Gurugram is on the Haryana government property portal. For sale deeds within municipal limits the reported rates are 7 percent for a man, 5 percent for a woman and 6 percent for joint ownership. Registration fees run on value slabs up to a cap of Rs 50,000.
- Step 6: Deduct TDS if applicable. On property purchases above the threshold in the income-tax law, the buyer deducts TDS and deposits it. From 1 April 2026 the challan-cum-statement is Form 141 (replacing Form 26QB), due within 30 days from the end of the month of deduction, and the seller’s certificate is Form 132.
- Step 7: Register online. Haryana made paperless deed registration mandatory across all 22 districts from 1 November 2025 through eregistration.revenueharyana.gov.in. Parties apply online, upload documents, book an appointment, and visit the sub-registrar once for biometric verification and execution. Paperless Registration 2.0, launched in June 2026, made Aadhaar-based e-KYC mandatory for both parties and integrated mutation.
- Step 8: Mutation and transfers. With the auto-mutation system, separate mutation applications are no longer needed after registration. Still update the municipal Property ID record, the society register, electricity and water connections and the maintenance account in your name.
Cost checklist
| Item | Who usually pays | Notes |
|---|---|---|
| Stamp duty | Buyer | On higher of deed value and collector rate; rate depends on buyer’s gender and area |
| Registration fee | Buyer | Slab-based, capped at Rs 50,000 |
| Builder transfer fee (allotment transfers) | Negotiable; often seller | Get written schedule |
| Pending maintenance and municipal dues | Seller | Clear before registry |
| Brokerage | As agreed | Use a RERA-registered agent |
| Legal fees and due diligence | Buyer | Worth it on every resale |
Red flags
- No occupation certificate for the tower, or an OC covering a different phase.
- Seller holds a GPA, an agreement to sell or a notarised affidavit instead of a registered deed.
- Area in the deed differs from the area on the builder’s records or the maintenance bill.
- Plot or independent floor in a colony that is not licensed or regularised, where a Section 7A planning NOC may be needed for the transfer.
- Seller pressing for a large cash component; it raises your stamp duty risk and leaves you without proof of payment.
- Unexplained gaps in the title chain or a deed registered at a far lower value than the collector rate of that year.
As of October 2026
The registration fee slabs, including the Rs 50,000 cap above Rs 90 lakh, match the stamp duty and registration fee schedule on the Haryana revenue department’s Jamabandi portal. The stamp duty percentages are as reported by lender guides for 2026, because we could not find them in an official notification; check them with the portal’s stamp duty calculator or the sub-registrar before execution. Collector rates are revised annually. This guide is general information, not legal advice.
Frequently asked questions
Can I buy a resale flat in Gurugram that has no conveyance deed yet?
Yes, as an allotment transfer through the builder, which records you as the new allottee. Until the conveyance deed is executed in your name, you hold contractual rights, not title.
Is a GPA sale safe for a Gurugram flat?
No. In Suraj Lamp (2011) the Supreme Court held that agreement-GPA-will transactions do not transfer title. Insist on a registered sale deed or a builder endorsement.
What is the NDC and where do I get it?
It is a No Dues Certificate from the urban local body confirming no property tax or municipal dues against the Property ID. It is generated on property.ulbharyana.gov.in once dues are nil.
Do I need to apply for mutation separately after registry?
Haryana's auto-mutation system, launched in June 2026, integrates mutation with registration, so a separate application is no longer needed. Update society, utility and municipal records yourself.
What stamp duty applies to a resale flat in Gurugram?
Reported 2026 rates within municipal limits are 7 percent for men, 5 percent for women and 6 percent for joint ownership, on the higher of deed value and collector rate, plus a slab registration fee capped at Rs 50,000.
