Part Occupancy Certificate: What a Partial or Conditional OC Means for Your Flat

Contents
Large NCR projects are rarely finished in one go. A Noida Expressway society might have six towers completed and three still under construction; a Gurugram project might hand over Phase 1 while Phase 2 is a hole in the ground. Authorities deal with this by issuing an occupancy certificate for part of a project: specific towers, floors or phases. Buyers then hear phrases like “part OC”, “partial OC” or, since the Sports City settlement in Noida, “conditional OC”. This guide explains what each means, how it affects your possession, registry, loan and maintenance, and how to check exactly what your tower’s certificate covers.
First, the basics: OC and CC
The RERA Act defines the occupancy certificate as the certificate, or similar permission, issued by the competent authority permitting occupation of a building that has provision for civic infrastructure such as water, sanitation and electricity. The completion certificate certifies that the project has been developed according to the sanctioned plan. Under Section 19(10), an allottee must take physical possession within two months of the occupancy certificate for the unit. Under Section 17, the conveyance deed is to be executed as per local law or, where local law is silent, within three months of the OC. Our separate guide on OC versus CC explains the difference in detail.
What a part OC is
A part OC is an occupancy certificate for a defined portion of a project, usually named towers or blocks, once those portions have been built as per plan and have their own fire, lift, structural and service clearances. The rest of the project remains under construction and needs its own OC later.
Building rules in NCR are written to allow this. The Haryana Building Code, as amended for ease of doing business, says no person may occupy or allow others to occupy any new building “or a part thereof” until an occupation certificate is issued, and sets procedures, including self-certification for low-risk buildings and deemed OC if the authority does not respond within the prescribed days. The phrasing makes clear that occupation is tied to the certificate for the part you occupy, not to the project as a whole.
Part OC, conditional OC and full OC compared
| Type | What it covers | Can you legally move in? | Typical buyer issues |
|---|---|---|---|
| Full OC | All towers and common facilities in the sanctioned plan | Yes | Few; check defects and amenities |
| Part OC | Named towers, blocks or phases | Yes, if your tower is named | Construction next door; shared amenities incomplete; registry may wait for dues clearance |
| Conditional OC | Certificate issued subject to conditions, such as dues payment or completion of specified facilities | Yes, subject to conditions | Conditions may affect registry or later approvals |
| No OC, “fit-out possession” | Nothing | No | Illegal occupation; utilities and registry problems |
Recent NCR examples
- Noida Sports City, Sector 150. OCs, registries and sales in group housing under the Sports City scheme were frozen from January 2021 over incomplete sports infrastructure. Following Supreme Court guidelines of November 2025 directing the Noida Authority to issue conditional occupation certificates where builders complied with building norms and cleared dues, the Authority’s 221st board meeting in January 2026 lifted the ban and issued the first conditional OC. By October 2026, four projects had received conditional OCs after clearing outstanding dues, and a revised master layout plan retaining 70 percent of the area for sports, recreation, institutional uses and open space had been approved.
- Noida Authority disclosures. Since March 2023 the Noida Authority’s website has carried project-wise information on group housing projects, including OC and CC status, pending dues and sub-lease documentation, under “Group Housing Builder Projects Information”. This is the easiest way to see which towers of a Noida project hold an OC.
What a part OC means for you
If your tower is covered
- Possession. The builder can make a valid offer of possession. UP RERA has told promoters to send a written offer of possession within two months of getting the CC or OC, by registered email and post, and to display copies of the CC or OC at their CRM offices.
- Your two-month window. Section 19(10) expects you to take possession within two months of the OC. Inspect, prepare a snag list and take over; delaying without reason can expose you to holding charges under the agreement.
- Utilities. The Supreme Court directed in December 2024 that electricity, water supply and sewerage connections be given only after production of the completion or occupation certificate. A part OC naming your tower supports permanent connections for it.
- Registry. In Noida and Greater Noida, an OC does not by itself guarantee a sub-lease or sale deed; the authority may hold registries if the builder’s land dues are unpaid. Ask whether registries have started in OC towers.
- Delay interest. Interest under Section 18 for delayed possession normally runs until a valid offer of possession after the OC for your unit. A part OC for other towers does not stop interest on yours.
If your tower is not covered
- Do not accept “fit-out” or “soft” possession. UP RERA in May 2025 ordered developers to stop handing over incomplete or bare-shell flats, warning that possession can be offered only after a CC or OC and that offering possession without an OC is illegal, with penalties up to 5 percent of project cost.
- Keep your delay-interest claim alive; do not sign undertakings waiving it.
- Track the remaining towers’ progress on the RERA portal’s quarterly updates.
Living in a part-OC project: practical issues
- Safety and access. Construction traffic, cranes and dust next to occupied towers. Ask for separate site access and barricading in writing.
- Common amenities. The clubhouse, pool or second entry may belong to a later phase. Check which facilities were part of the OC’d portion.
- Maintenance charges. Builders sometimes bill maintenance for the whole project while only some facilities work. Ask for a breakdown and the basis of calculation.
- Handover to the association. Section 17 and state apartment laws require common areas and documents to be handed to the association of allottees. In a phased project, agree how and when each phase’s common areas will transfer.
- Fire and lift approvals. Confirm your tower has its own fire NOC and lift licences, not just the project’s.
Step-by-step: verifying a part OC
- Step 1: Ask the builder for the OC document, not a letter about it. Read the schedule listing towers, floors and unit counts.
- Step 2: Match your tower number and floor with the schedule. Some OCs exclude specific floors or penthouses.
- Step 3: In Noida, cross-check on the Noida Authority’s group housing information page; in Gurugram, check the OC on the town planning department’s records or the RERA project page.
- Step 4: Check any conditions in a conditional OC and ask the builder how and when they will be met.
- Step 5: Ask whether registries or conveyance deeds have begun for units in the OC’d towers.
- Step 6: Inspect your flat against the agreement’s specifications before accepting possession.
Red flags
- “OC applied for” presented as if it were an OC.
- An OC for Phase 1 used to offer possession in a Phase 2 tower.
- Possession letters that require you to waive delay interest or accept bare-shell handover.
- Temporary electricity connections months after “possession”.
- Registries not starting in OC’d towers, often a sign of unpaid authority dues.
As of October 2026
The legal points come from the RERA Act, the Haryana Building Code amendments and court directions cited below. Authority practice on conditional OCs and registries changes, especially in Noida’s Sports City projects. Verify your tower’s status on the authority and RERA portals before taking possession.
Frequently asked questions
Can I move in if the project has only a part OC?
Yes, if your tower or unit is listed in the OC. If your tower is not covered, possession should not be offered, and UP RERA has said offering possession without an OC is illegal.
Does a part OC stop my delay interest?
Only for units covered by it, from a valid offer of possession. A part OC for other towers does not end delay interest on your unit.
What is a conditional OC?
An occupancy certificate issued subject to conditions, such as clearing dues or completing facilities. In 2026 the Noida Authority began issuing conditional OCs to compliant Sports City projects after Supreme Court guidelines.
How can I check which towers have an OC in Noida?
The Noida Authority's website lists project-wise OC and CC status, pending dues and sub-lease status under Group Housing Builder Projects Information.
Will I get permanent electricity and water with a part OC?
The Supreme Court directed in December 2024 that electricity, water and sewer connections be given only on production of a completion or occupation certificate, so an OC covering your tower supports permanent connections.
