When a Gurugram builder misses the possession date, changes the plan, refuses a refund or will not register your , the Haryana Real Estate Regulatory Authority at Gurugram is usually the fastest forum available. Filing is not complicated, but buyers lose months by choosing the wrong forum, asking for the wrong relief or skipping service on the builder. This guide walks through who can file, which bench hears your case, what to ask for, the fees and paperwork reported for the Gurugram bench, how hearings and orders work, and how to enforce or appeal an order.

First, is HRERA Gurugram the right forum?

Haryana has two regulatory authorities. Since a notification in December 2017, the Gurugram authority’s jurisdiction has been confined to Gurugram district, and the Panchkula authority covers the rest of the state, including Faridabad, Sonipat, Panipat, Palwal, Rohtak and Jhajjar. A Sohna or New Gurgaon project falls under Gurugram if it lies in Gurugram district; a Neharpar Faridabad or Kundli project goes to Panchkula.

HRERA can hear complaints about any project that is registered under , or that ought to have been registered. The authority also hears complaints by promoters against allottees, for example for unpaid instalments. Remember these limits:

  • You must be an allottee. The RERA Act defines an allottee as the person to whom the unit has been allotted or sold, including a subsequent purchaser of the allotment, but not a tenant. In a 2026 Gurugram case involving a provisional allotment in an Eldeco project, HRERA held that a booking amount and a provisional did not make the complainant an allottee where the allotment was expressly conditional on an that was never executed. If your booking is only provisional, get the agreement executed or document why it was not.
  • Civil courts are barred from matters the authority or adjudicating officer can decide (Section 79), but RERA is in addition to other laws (Section 88). Buyers can still choose consumer commissions for some claims. Do not run the same relief in two forums at once.

Authority or Adjudicating Officer: what to ask for, and where

Section 31 lets an aggrieved person complain to the authority or to the adjudicating officer “as the case may be”. The split matters because each decides different relief.

Relief you want Who decides Legal basis
Refund of money with interest after a delay Authority Section 18(1), with interest at the rate in the Haryana rules
Interest for every month of delay while you stay in the project Authority Proviso to Section 18(1)
Directions: hand over possession, execute conveyance deed, rectify defects, stop illegal demands Authority Sections 11, 17, 14(3), 37
Compensation for loss, mental harassment or litigation cost under Sections 12, 14, 18 and 19 Adjudicating Officer Section 71, read with Section 72 factors

In practice many buyers file for refund or delay interest before the authority, and file a separate application before the adjudicating officer if they want compensation beyond interest. The Act tells both the authority (Section 29(4)) and the adjudicating officer (Section 71(2)) to try to dispose of matters within 60 days and to record reasons if they cannot; real timelines are usually longer.

What interest will HRERA apply?

The Haryana rules fix the rate as SBI’s highest marginal cost of lending rate plus 2 percent, as our guide to delay interest explains. SBI revised its MCLR on 15 October 2026, with the one-year tenor at 8.85 percent and the three-year tenor at 8.95 percent, so check the rate the authority applies on the date of your order.

Before you file: build the file

  • Allotment letter, agreement for sale or builder-buyer agreement, and any addendum.
  • Every payment receipt and bank statement entry, with a running total. HRERA orders usually compute interest from each payment date.
  • Demand letters, possession offer (if any), and the builder’s replies.
  • The project’s RERA registration certificate, declared completion date and any extension. HRERA Gurugram ordered in August 2026 that completion dates falling on or after 28 February 2026 stand automatically extended by four months on account of the West Asia war, for projects registered on or before 31 July 2026. Factor this into your delay calculation.
  • A legal notice sent to the builder, with proof of delivery. It is not mandatory, but it shows you gave the builder a chance and often triggers a settlement offer.
  • For a resale purchase, the builder’s endorsement or transfer letter recording you as allottee.

Step-by-step: filing a complaint with HRERA Gurugram

The steps below follow a published summary of the Gurugram bench’s complaint process, which refers to complaint regulations dated 16 December 2018, checked against the Haryana RERA Rules, 2017. HRERA Gurugram’s website is hareraggm.gov.in. When we checked in October 2026, its complaint sign-in page showed “Under Maintenance” and its complaint search pages returned errors, so confirm current forms and fees at the authority’s office (New PWD Rest House, Civil Lines, Gurugram) before filing.

  • Step 1: Read the regulations and forms. The Haryana RERA Rules, 2017 prescribe separate formats: a complaint to the authority is filed in Form ‘CRA’ (rule 28), and a complaint to the adjudicating officer for interest and compensation under Sections 12, 14, 18 and 19 is filed in Form ‘CAO’ (rule 29), each in triplicate. Use the right one for the relief you want.
  • Step 2: Register online. On hareraggm.gov.in, open the Complaint menu and choose Authority/ Adjudicating/Execution Sign-Up. The sign-up form asks who is filing (self, advocate, CA, CS or other) and whether you are a buyer, promoter or agent. After signing in, fill in the complaint and note the complaint number generated. If online filing is unavailable, ask the authority’s office how to file on paper.
  • Step 3: Pay the fee. Schedule III of the Haryana RERA Rules, 2017 sets the fee for a complaint before the authority at Rs 1,000, plus Rs 10 for every annexure and Rs 20 for every additional affidavit, and a separate Rs 1,000 if you later file an amended complaint. The rules provide for payment by demand draft or banker’s cheque on a scheduled bank in favour of “Haryana Real Estate Regulatory Authority”, and the forms as amended also have a field for an online payment transaction number; ask the Gurugram office which mode it currently accepts.
  • Step 4: Prepare the complaint. Type it in the prescribed format: parties, project and unit details, facts in date order, the violation of each section, and the exact relief, for example “refund of Rs 62,40,000 paid between March 2021 and June 2023 with interest at the prescribed rate from each date of payment”.
  • Step 5: Serve the builder. Send a copy to each respondent by email and speed post, and keep the tracking report and email record. Attach a signed declaration of service.
  • Step 6: File hard copies. Submit the printed registration form, the complaint with annexures, the fee and extra respondent sets at the authority’s office in Gurugram, and keep soft copies (Word and PDF) ready, as the summary notes they are requested.
  • Step 7: Track the case. Use the complaint number to check hearing dates and orders online.

Hearings and orders

The builder is given time to reply, after which the bench hears both sides, sometimes over several dates. Common builder defences are force majeure (COVID-19, construction bans, the 2026 West Asia extension), the buyer’s own payment default, and the claim that the buyer is a speculative investor. Answer each with documents: the agreement’s force majeure clause, your payment record, and the dates of any RERA extension.

Orders normally direct payment within a fixed compliance period stated in the order; note that date, because execution can be sought only after it passes. If you chose to stay in the project, the order may fix monthly delay interest until a valid offer of possession after the .

If the builder does not pay: execution

  • Execution petition. File for execution before the authority once the compliance period expires.
  • Recovery as land revenue. Section 40 makes unpaid interest, penalty or compensation recoverable as arrears of land revenue, which means the district revenue machinery can attach the builder’s property.
  • Penalty for non-compliance. The Act allows the authority to impose penalties on promoters who fail to comply with its orders.

Appeals

Either side can appeal to the Haryana Real Estate Appellate Tribunal within 60 days of receiving the order (Section 44). The tribunal is to try to decide within 60 days. A promoter’s appeal will not be heard until it deposits at least 30 percent of the penalty, or the full amount payable to the allottee including interest and compensation, or both, as the tribunal decides (proviso to Section 43(5)). This pre-deposit is a strong protection for buyers. A further appeal lies to the Punjab and Haryana High Court within 60 days of the tribunal’s decision (Section 58).

Costs and timeline at a glance

Stage Typical cost What to expect
Legal notice Lawyer’s fee, if used Often prompts a settlement offer
Complaint before authority Rs 1,000 plus Rs 10 per annexure and Rs 20 per additional affidavit (Haryana RERA Rules, Schedule III) Several hearings; statutory target of 60 days rarely met
Compensation application before adjudicating officer Check current fee Separate proceeding
Execution Minimal Recovery certificate route if the builder defaults
Appeal by builder Rs 1,000 filing fee (Schedule III); builder must also pre-deposit Within 60 days of order

Mistakes that weaken a Gurugram complaint

  • Asking for refund and possession in the same breath. Choose one primary relief, with the other in the alternative.
  • Filing before the agreed possession date plus any valid grace period and RERA extension.
  • Missing payment proofs, or showing payments made in cash or to a group company.
  • Accepting a possession offer and signing an indemnity that waives delay interest without reading it.
  • Not updating the authority when you sell or assign the unit during the case.

As of October 2026

Statutory provisions above come from the RERA Act. Form names and fee amounts are from the Haryana RERA Rules, 2017 as published in July 2017. The filing sequence comes from a third-party summary of the Gurugram bench’s process, because HRERA Gurugram’s online complaint pages were under maintenance when we checked; verify it before filing.
