Supreme Court issues notice on NBCC plea for RERA relief in Supertech projects

Contents
What happened
On 17 August 2026 the Supreme Court issued notice on a petition by NBCC challenging the National Company Law Appellate Tribunal’s refusal to relax RERA requirements for the 16 stalled Supertech projects NBCC has been asked to complete. The court sought responses from the Centre and from Supertech’s former promoter, and listed the matter for 24 September 2026.
What NBCC wants
According to legal reports, NBCC asked for relief from two RERA requirements:
- Keeping 70% of money collected from buyers of each project in that project’s separate account.
- Getting allottees’ consent before rights in a project are transferred to a new promoter.
NBCC argues the 16 projects are at very different stages, and that it needs to use surplus collections from healthier projects to fund weaker ones. The NCLAT, in its 22 May 2026 order, said it was not competent to exempt anyone from a statute and instead directed RERA authorities to process approvals within set timelines.
What it means for buyers
This is a real trade-off. Ring-fencing each project’s money protects buyers of that project from having their payments used elsewhere – the very practice that contributed to Supertech’s collapse. But strict ring-fencing could leave weaker projects without enough money to restart, delaying them further.
- Buyers in projects with large unsold inventory or high pending collections may see their money used for other projects if the court allows pooling.
- Buyers in projects with funding gaps may benefit from pooling.
The October affidavit before the NCLAT set 16 January 2027 as the construction start date for the 16 projects, so the court’s view on fund use will shape how fast each one moves.
What to check
- The outcome of the Supreme Court hearing (we had not seen a reported result at the time of writing).
- Whether your project is among the 16 handled by NBCC, such as Eco Village 1, Czar Suites or Upcountry, or among those given to a co-developer.
- Your buyer association’s position – associations are often heard in these proceedings.
Whatever the court decides, buyers should keep their own records of every payment made to Supertech, with unit numbers, since claims and balance demands will be reconciled project by project.
